These Terms and Conditions (“Terms”) govern your access to and use of the SymptomIQ website, products, services, reports, and platform (collectively, the “Services”).

By accessing or using the Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.

If you do not agree to these Terms, you must not access or use the Services.

Acceptance of Terms

By accessing or using the Services, you agree to comply with these Terms and all applicable laws.

We may update these Terms from time to time. Where material changes are made, we will publish the updated Terms on our website and update the “Last Updated” date. Your continued use of the Services after any changes become effective constitutes acceptance of the revised Terms.

Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, disclose, and protect your personal information, including health-related information.

By using the Services, you acknowledge that you have read and understood our Privacy Policy.

Eligibility

You must be at least 18 years of age to use the Services.

If you are under 18 years of age, you may only use the Services with the consent and supervision of your parent or legal guardian.

You represent and warrant that all information you provide to SymptomIQ is accurate, complete, and up to date.

Health Information Disclaimer

SymptomIQ provides educational information and wellness support only.

The Services—including questionnaires, wellness assessments, Hair Tissue Mineral Analysis (HTMA) summaries, educational resources, supplement recommendations, and automated recommendations—are provided for informational purposes only and are not intended to diagnose, treat, cure, prevent, or monitor any disease or medical condition.

SymptomIQ does not:

  • diagnose diseases;
  • provide medical advice;
  • prescribe medications;
  • provide medical treatment;
  • replace licensed healthcare professionals.

Hair Tissue Mineral Analysis (HTMA) is an observational wellness assessment intended to identify mineral patterns and trends. It should not be relied upon as a substitute for medical testing, diagnosis, or treatment.

Some recommendations may be generated using automated systems based on information you provide. These recommendations should not be interpreted as medical advice.

By using the Services, you acknowledge that:

  • recommendations are educational only;
  • recommendations may not be appropriate for your individual circumstances;
  • individual health outcomes vary;
  • supplement recommendations are not medical prescriptions;
  • no outcome or result is guaranteed.

You remain solely responsible for seeking independent medical advice regarding any health concern.

If you believe you are experiencing a medical emergency, contact your doctor or emergency services immediately.

Laboratory Reports

Where laboratory testing is provided, the analysis is performed by independent accredited laboratories.

SymptomIQ provides educational summaries and interpretations of laboratory reports but is not responsible for laboratory testing procedures, methodologies, analytical errors, delays, omissions, or other matters attributable to third-party laboratories.

No Warranty

To the maximum extent permitted by law, the Services are provided on an “as is” and “as available” basis.

SymptomIQ does not warrant that:

  • assessments will always be accurate or complete;
  • recommendations will be appropriate for every individual;
  • products or supplements will achieve any particular outcome;
  • the Services will be uninterrupted, secure, or error-free;
  • information will always be current, complete, or available.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy available under the Australian Consumer Law or any other legislation that cannot lawfully be excluded.

Supplement and Wellness Products

If you purchase supplements, minerals, or other wellness products through SymptomIQ, you acknowledge that:

  • individual responses vary;
  • results cannot be guaranteed;
  • supplements may interact with medications or medical conditions;
  • allergic reactions or side effects may occur;
  • dosage recommendations should be followed carefully.

Pregnant or breastfeeding individuals, children, and anyone with diagnosed medical conditions should consult an appropriately qualified healthcare professional before commencing any supplement program.

If you experience an adverse reaction, discontinue use immediately and seek appropriate medical advice.

To the maximum extent permitted by law, SymptomIQ is not responsible for adverse outcomes arising from:

  • failure to follow product instructions;
  • misuse of products;
  • undisclosed medical conditions;
  • undisclosed medications;
  • allergic reactions;
  • interactions with medications;
  • failure to obtain appropriate medical advice.

User Responsibilities

You agree to:

  • provide accurate and truthful information;
  • use the Services only for lawful purposes;
  • review all product information before use;
  • seek professional medical advice where appropriate;
  • make your own informed health decisions.

You must not:

  • impersonate another person;
  • provide false information;
  • upload unlawful, harmful, or malicious content;
  • interfere with or disrupt the Services;
  • attempt unauthorized access to any system;
  • reverse engineer or copy the platform;
  • use the Services for any unlawful purpose.

Intellectual Property

All content made available through the Services (including reports, graphics, software, text, databases, branding, logos, trademarks, designs, educational materials, questionnaires, recommendations, and proprietary methodologies)is owned by or licensed to SymptomIQ.

Your purchase grants you a limited, non-exclusive, non-transferable licence to access and use the Services for your personal, non-commercial use only.

You must not reproduce, distribute, modify, publish, sell, or commercially exploit any part of the Services without SymptomIQ’s prior written consent.

Payment Information

SymptomIQ does not store sensitive payment information on its own servers.

Where you choose to save a payment method, your card details are transmitted directly to our PCI-DSS compliant payment provider and stored exclusively within their secure infrastructure.

SymptomIQ only stores a secure payment token together with limited display information, such as your card type and last four digits, allowing future payments to be processed without storing your full card details.

You may remove your saved payment methods at any time through your account settings.

Refunds

Refunds are provided in accordance with the Australian Consumer Law.

Nothing in these Terms limits your statutory rights regarding faulty goods or services.

Unless otherwise required by law, change-of-mind refunds are not available once laboratory processing has commenced or where supplements or other products have been opened or used.

Third-Party Services

The Services may include links to or integrate with third-party websites, laboratories, payment providers, shipping providers, or other service providers.

SymptomIQ does not control and is not responsible for the content, privacy practices, products, services, or conduct of any third party.

Indemnity

You agree to indemnify and hold harmless SymptomIQ, its directors, officers, employees, contractors, affiliates, licensors, suppliers, and service providers against any loss, liability, claim, damage, cost, or expense arising from:

  • your breach of these Terms;
  • your unlawful use of the Services;
  • your misuse of reports, recommendations, or products;
  • your infringement of another person’s rights.

This indemnity applies only to the extent permitted by applicable law.

Limitation of Liability

Nothing in these Terms excludes, restricts, or modifies any rights or remedies available to you under the Australian Consumer Law or other legislation that cannot legally be excluded.

To the maximum extent permitted by law, SymptomIQ’s total aggregate liability arising out of or relating to the Services shall not exceed the greater of:

  • the total amount paid by you to SymptomIQ during the twelve (12) months immediately preceding the event giving rise to the claim; or
  • AUD $100.

To the maximum extent permitted by law, SymptomIQ shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, business interruption, loss of goodwill, loss of opportunity, or loss of data arising from your use of the Services.

Where liability cannot be excluded under the Australian Consumer Law, SymptomIQ’s liability is limited, at its option, to:

  • re-supplying the Services; or
  • paying the cost of having the Services supplied again,

to the extent permitted by law.

Suspension and Termination

SymptomIQ may suspend or terminate your access where reasonably necessary, including where:

  • you breach these Terms;
  • fraudulent or unlawful activity is suspected;
  • continued access may compromise the security or integrity of the Services.

Termination does not affect any rights or obligations that have accrued before termination.

Dispute Resolution

If a dispute arises, both parties agree to first attempt to resolve the matter through good-faith discussions.

If the dispute cannot be resolved within thirty (30) days, either party may seek mediation before commencing court proceedings, unless urgent interlocutory or equitable relief is required.

Nothing in this clause limits any rights available under the Australian Consumer Law.

Governing Law

These Terms are governed by the laws of Victoria, Australia.

Subject to any applicable rights under Australian law, the courts of Victoria shall have jurisdiction over disputes relating to these Terms.

Force Majeure

By using the Services, you consent to receive notices, reports, invoices, updates, and other communications electronically.

Electronic communications satisfy any legal requirement that such communications be provided in writing.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any policies expressly incorporated by reference, constitute the entire agreement between you and SymptomIQ regarding your use of the Services.
